PROCEDURES
1.
REQUESTING INFORMATION
1.1
Any individual (or “Applicant”) may file a Formal Access to Information Request by
submitting either an Access to Information Request Form or making a request in
writing, to the Access and Privacy Office.

1.2
The Formal Access to Information Request submitted by the Applicant must include
at minimum the following:
a. A description of the Record(s) that the individual is seeking access to;
b. The date range of the Record(s) being sought;
c. The Department/Faculty/Area/individual where the Record(s) containing the
information resides, if known;
d. Sufficient detail such that the information can be located or identified in an
efficient manner as required under the Act;
e. The contact information of the person requesting the information, such as: name,
address, phone number and email, and;
f. For requests that deal with Personal Information, authentication of identity is
required.

1.3
The Access and Privacy Office will review the request, acknowledge receipt of the
request, advise the requestor of the time required to complete the request, and
provide details of any additional fees that are applicable in accordance with the Act.
1.4
The Access and Privacy Office will provide its final response to a Formal Access to
Information Request on behalf of the University within 30 business days of initial
receipt. That timeline may be extended as outlined under the Act. The Access and
Privacy Office will notify the Applicant of the anticipated date of final response or if a
timeline extension is warranted.
1.5
If the Records sought in a Formal Access to Information Request are teaching
materials, questions on an examination or test or research information of a faculty
member then access will be denied on the basis that the Records are excluded from
the Act.
1.6
In the event that the Formal Access to Information Request does not provide enough
detail to enable Records to be located or identified within a reasonable time with
reasonable effort, the Access and Privacy Office may contact the Applicant for
further clarification.
1.7
The Applicant must respond to the Access and Privacy Office communication
seeking further clarification concerning the submitted scope of their request within
30 business days. If the Applicant does not respond, the Formal Access to
Information Request will be deemed abandoned.
2.
IDENTIFYING, LOCATING, AND RETRIEVING RELEVANT RECORDS
2.1
The Access and Privacy Office will provide a formal request to the specific Employee
who may hold the Records requested. Where the Records are held by a Department,
the formal request will be sent to the Department Head(s) of the Department(s) that
may hold the information contained in the Records requested. The formal request
will include:
2.1.1 The scope of the Formal Access to Information Request; and
2.1.2 A timeline for completion of identifying, locating, and retrieving the relevant
Records as established by the Access and Privacy Office.
2.2
Employees and Department Heads are responsible to ensure that unredacted copies
of all Records and information that are responsive to the Formal Access to
Information Request, and that are held by their Department are provided to the
Access and Privacy Office.
2.3
The Department Head may delegate specific tasks to fulfill the request to Employees
in the Department, however, the Department Head remains accountable for the
Records and information produced.
2.4
Departments will not exclude any responsive Records or revise, redact, or destroy
any Record that is submitted to the Access and Privacy Office.
2.5
The Access and Privacy Office is responsible for assessing information contained
within the Records provided by Departments, determining what redactions are
necessary and what will be released to the Applicant.

2.6
The Access and Privacy Office may require Departments to provide information on
how they identified, located, or retrieved relevant Records to ensure the University
has taken reasonable steps to fulfill its obligations under the Act
2.7
Formal Access to Information Requests which seek Health Information subject to the
Alberta Health Information Act will be directed by the Access and Privacy Office to
the applicable Health Custodian, as defined in the Health Information Act.
3.
RELEASING INFORMATION
3.1
The Access and Privacy Office will make the determination on whether the
information contained within a Record is classified as:
a. Disclosable information that must be released under the Act;
b. Non-disclosable information that must not be released under the Act; and
c. Discretionary information that is not required to be released under the Act but
may be released at the discretion of the University.
3.2
If the Access and Privacy Office determines that information contained within a
Record is deemed to be disclosable information that must be released under the Act,
that Office will release the information to the requestor.
3.3
If the Access and Privacy Office determines that the information contained within a
Record is non-disclosable information that must not be released under the Act, that
Office will not release that information to the requestor.
3.4
If the Access and Privacy Office determines that the information contained within a
Record is discretionary information that may be released at the discretion of the
University, the Access and Privacy Office will only release the discretionary
information in consultation with the applicable Department Head(s). .
3.5
Applicants that submit a Formal Access to Information Request to the University in
writing have the right to ask the Commissioner to review any decision, act or failure
to act by the Access and Privacy Office concerning their response to the formal
access request.
B.
DEFINITIONS
(1)
Access and Privacy
Office:
means the Information Management & Privacy Advisor
and/or Senior Leaders of the Access & Privacy Office
as delegated by the President in writing.
(2)
Act:
means the Access to Information Act of Alberta. Also
referred to as “ATIA”.
(3)
Commissioner:
means the Information and Privacy Commissioner
appointed in accordance with the Act.
(4)
Department:
means a faculty within the Academic Division or a
department outside of the Academic Division.
(5)
Department Head:
means the leader of a Department.

(6)
Employee:
means individuals who are engaged to work for the
University under an employment contract, including but
not limited to faculty, staff, exempt, casual and
management employees.
(7)
Formal Access to
Information Request:
means a request for access to information/Records
made to the University through the Access and Privacy
Office under the formal processes under the Act.
(8)
Policy:
means the Access to Information Policy.
(9)
Record:
means any electronic record or other record in any form
in which information is contained or stored, including
information in any written, graphic, electronic, digital,
photographic, audio or other medium, but does not
include any software or other mechanism used to store
or produce the record.
(10)
University:
means Mount Royal University.
